1. Acceptance of These Terms

This site (the “Site”) is operated by FLOTE Labs Inc. (“FLOTE”, “we”, “us”, “our”). By using the Site or joining the waitlist, you agree to these Terms of Service and to our Privacy Policy.

We may modify these Terms. Changes take effect when posted, and continuing to use the Site means you accept them. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old to use this Site or to join the waitlist.

3. What the Waitlist Is

Joining the waitlist is free, involves no payment, and is not an order, a reservation, or a purchase. It is permission to email you.

To be specific about what it does and does not entitle you to:

• It does not reserve stock, a price, a discount, or a place in any allocation.
• It does not create any obligation on us to launch a product, to launch it in a particular month, or to launch it at all.
• It costs nothing, and you can leave at any time using the unsubscribe link in any email.

If we ever offer waitlist members something specific — early access, a launch price, a reward for referring somebody — the terms of that offer will be stated in the email that makes it, and those terms will govern it. Nothing on this page should be read as such an offer.

4. Pre-Launch Information

FLOTE SMART is in development. Formats, ingredients, formulations and timing described on this Site are our current plans, published so that you can judge them, and they may change.

• Ingredient lists name the actives a formulation is being built around. They are not final labels, and no dose on this Site is a product dose — where a dose appears, it is the dose used in the published research being described.
• A launch month is our current expectation, not a commitment. If it moves, we say so to the list.
• Nothing on this Site is an offer to sell a product, and no price is published here.

5. Intellectual Property

The Site and its content — text, design, graphics and the FLOTE and FLOTE SMART names and logos — are owned by FLOTE or its licensors and protected by intellectual property law. You may not reproduce, distribute or create derivative works from it without our written permission. Third-party ingredient trademarks named on this Site are the property of their respective owners.

6. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose.
• Submit an email address that is not yours, or otherwise submit false information.
• Attempt to gain unauthorized access to any part of the Site or its systems.
• Interfere with or disrupt the Site's operation.
• Use bots, scrapers or other automated tools against the Site or its forms without our permission.

7. Health Disclaimers

7.1 Not medical advice

Everything on this Site — including the ingredient and evidence pages — is educational. It is not medical advice and is not a substitute for professional medical advice, diagnosis or treatment. Where we describe published research, we are describing what was studied, not promising what a product will do for you.

7.2 FDA disclaimer

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease. Consult your healthcare provider before starting any supplement, particularly if you are pregnant, nursing, taking medication, or have a medical condition.

7.3 Individual results

Results vary from person to person. We guarantee no specific outcome from any product.

8. Links to Other Sites

This Site links to flotelabs.com and to shopflote.com, our FLOTE RADIANCE brand, and may link to third-party sources. We are not responsible for the content or policies of any site other than this one, and each FLOTE site has its own policies and its own mailing list.

9. Limitation of Liability

To the maximum extent permitted by law:

• FLOTE is not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site.
• Because nothing on this Site is sold, our total liability for any claim arising from these Terms or your use of the Site will not exceed US $100.
• We are not liable for delays or failures caused by events beyond our reasonable control.

10. Indemnification

You agree to indemnify and hold harmless FLOTE Labs Inc., its officers, directors, employees and agents from any claims, damages, losses or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Site.

11. Dispute Resolution

11.1 Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

11.2 Informal resolution first

Before filing any formal dispute, contact us at support@flotelabs.com. We will make good-faith efforts to resolve it within 30 days.

11.3 Arbitration

If informal resolution fails, any dispute arising from these Terms will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, taking place in Pinellas County, Florida. You agree to waive any right to a jury trial or to participate in a class action.

11.4 Exceptions

Either party may seek injunctive relief in a court of competent jurisdiction for intellectual property infringement or unauthorized access to the Site.

12. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the rest continue in full force. These Terms, together with our Privacy Policy, are the entire agreement between you and FLOTE regarding your use of this Site.
